The applicant, an undischarged bankrupt, seeks special leave to appeal against orders made by a single judge of the Federal Court of Australia (Lander J) dismissing the applicant's appeal against orders of the Federal Magistrates Court.
As long ago as 21 December 2001 a registrar of the Federal Magistrates Court (Registrar Christie) made a sequestration order against the estate of the applicant. On 28 January 2010, Simpson FM dismissed an application by the applicant by which he sought various orders including an order that the creditor's petition on which the sequestration order of 21 December 2001 had been made be set aside. The applicant appealed to the Federal Court of Australia against the orders of Simpson FM and it is the orders of Lander J dismissing that appeal which he now seeks special leave to challenge in this Court.
On 15 June 2011, Crennan J ordered that the time for filing the applicant's written case be extended. The costs of that application were reserved.
The applicant advances no arguable reason to doubt the correctness of the decision of Lander J.
Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application. The respondents should have the costs of the application for extension of time. The order to be drawn up, signed and sealed by the Registrar should so provide.
