Case

[2011] HCASL 152

ROBERT JOHN BADCOCK
v
PIRIE STREET HOLDINGS LIMITED (ACN 061 461 550) (FORMERLY ADELAIDE BANK LIMITED) & ANOR
[2011] HCASL 152
A16/2010

  1. The applicant, an undischarged bankrupt, seeks special leave to appeal against orders made by a single judge of the Federal Court of Australia (Lander J) in June 2010 dismissing the applicant's application for an extension of time within which to appeal against orders made by the Federal Magistrates Court in February 2002.  The Federal Magistrate (Raphael FM) had dismissed the applicant's application for a review of the exercise of power by a Registrar of the Federal Magistrates Court (Registrar Christie).  Registrar Christie had made a sequestration order against the applicant's estate.

  2. On 15 June 2011, Crennan J ordered that the time for filing the applicant's written case be extended.  The costs of that application were reserved.

  3. There is no reason advanced to doubt the correctness of the decision of Lander J.

  4. Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application.  The respondents should have the costs of the application for extension of time.  The order to be drawn up, signed and sealed by the Registrar should so provide.
