1—Short title

These regulations may be cited as the Roads (Opening and Closing) (Fees) Variation Regulations 2009.

2—Commencement

These regulations will come into operation on 1 July 2009.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Roads (Opening and Closing) (Fees) Regulations 2006

4—Substitution of Schedule 1

Schedule 1—delete the Schedule and substitute:

On deposit with the Surveyor‑General of preliminary plan and statement under section 9 of Act

For notification of a proposed road process by the Surveyor‑General under section 10 of Act (payable, on deposit of the preliminary plan and statement, by the council commencing the road process)

On deposit with the Surveyor‑General of a survey plan under section 20 of Act—

    (a)    examination fee—

     (i)     where the plan is an uncertified data plan

     (ii)    where the plan is a survey plan certified by a licensed surveyor

plus a further $380, payable by the surveyor, if the plan is resubmitted following rejection by the Surveyor‑General (However, the Surveyor‑General may waive or reduce the further fee if he or she considers that appropriate in a particular case having regard to the work involved in examining the resubmitted plan.)

    (b)    administration fee (payable in addition to examination fee)

On deposit of any other document with the Surveyor‑General under section 20 for which a fee is not otherwise provided in this Schedule (in addition to the fees payable in relation to the deposit of a survey plan)
