Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Roads Act 1993.

Explanatory note
The object of this Regulation is to declare the Roads and Traffic Authority to be the roads authority for certain public roads and parts of public roads being Boomerang Street, Chandos Street, Crane Avenue, Loudon Avenue, Minto Avenue, Mortley Avenue and Waratah Street in the local government area of Ashfield.

This Regulation also contains provision for the repeal of this amendment 2 months after its general regulation-making power).

1      Name of Regulation

This Regulation is the Roads (General) Amendment (M4 East
Motorway Declaration) Regulation 2005.

2 Amendment of Roads (General) Regulation 2000

(1)	The Roads (General) Regulation 2000 is amended as set out in Schedule 1.
(2)	Clause 79E of the Roads (General) Regulation 2000 (as inserted by this Regulation) is repealed at the beginning of the day that is 2 months after the day on which this Regulation commences.

Clause 79E

Insert after clause 79D:

79E	Roads Authority for public roads (M4 East Motorway project)
(1) The RTA is declared to be the roads authority for the public roads shaded mustard on sheet 1 of the plan marked “Plan No. 6004 010 SS 0409” being:

(a)

that part of Crane Avenue between Dobroyd Parade and Boomerang Street, Haberfield, and

(b)

that part of Loudon Avenue between Dobroyd Parade and Boomerang Street, Haberfield, and

(c)

Minto Avenue between Crane Avenue and Mortley Avenue, Haberfield, and

(d)

that part of Mortley Avenue between Dobroyd Parade and Boomerang Street, Haberfield, and

(e)

that part of Waratah Street between Dobroyd Parade and Boomerang Street, Haberfield.

(2)

The RTA is declared to be the roads authority for the public roads shaded mustard on sheet 2 of the plan marked “Plan No. 6004 010 SS 0409” being:

(a)	that part of Chandos Street between Loftus Street and Parramatta Road, Ashfield, and
(b)	that part of Chandos Street between Parramatta Road and Tinana Street, Haberfield.

(3)

In this clause, a reference to a plan is a reference to a plan held at the Client Services Directorate of the RTA at Level 2, 83 Flushcombe Road, Blacktown.

Note. Clause 2 (2) of the Roads (General) Amendment (M4 East Motorway Declaration) Regulation 2005 provides for the repeal of this clause at the beginning of the day that is 2 months after the day on which that Regulation commences.
