AN ACT for the Closing of certain Roads, and for other

purposes incidental thereto.

[Assented to 3rd January, 1919.]

1.    This Act may be cited as the Roads Closure Act, 1918. Short title.

4.    (1.) Subject as hereinafter provided, the roads and Closure of

Third Schedule to this Act may be closed by proclamation, and thereupon all rights of way over such roads or portions of roads shall cease, and the soil thereof shall be revested in His Majesty as of his former estate : Provided that such procla- mation shall not be published until the land described in Part 2 of the Third Schedule to this Act shall have been sur- rendered to His Majesty and proclaimed as public roads.

(2.)

On the land comprised in Part 2 of the Third Sche- dule to this Act being surrendered to His Majesty and pro- claimed as public roads, as aforesaid, the land described in Part 1 of the Third Schedule to this Act may be granted by His Majesty in fee simple in exchange for the land so sur- rendered.

(3.) The roads and portions of roads to be closed as aforesaid are delineated and coloured blue on a plan de- posited in the Office of Titles and numbered 4417, and the land to be surrendered to His Majesty and proclaimed as roads is delineated and coloured pink and green on the said plan.

a public road, all rights-of-way over that portion of the Rich- mond Crescent. East Fremantle, described in Part II. of the Fourth Schedule to this Act shall cease, and the soil thereof shall be revested in His Majesty as of his former estate, and may be granted in fee simple to the owners of the land described in Part I. of the said schedule in exchange , for the land surrendered as aforesaid.

All that portion of Dampier Terrace bounded by lines starting from a point situate North 76 links and East 48 links from the North-East corner of Broome Town Lot 270 and extending 54° 13 . 3 links ; thence 94° 23', 32 . 7 links ; thence 126° 50', 1 chain 36.7 links to the Eastern boundary of the aforesaid Terrace ; thence 185° 50', about 7 chains 44 links along said boundary ; thence 275° 56', 1 chain 61 . 7 links ; thence 5° 50', 3 chains 72 links ; thence 24° 22', 12 . 9 links ; thence 5° 58', 33 . 5 links ; thence 275° 58', 8 . 5 links ; thence 5° 58', 1 chain 5 links ; thence 95° 53', 8 . 5 links ; thence 5° 58', 34 links ; and thence 5° 14', 2 chains 47 . 6 links to the starting point.

The Second Schedule.

IN THE TOWNSITE OF MANDURAH.

All that portion of Lot 329 of Cockburn Sound Location 16 fronting 100 links on Ormsby Terrace and bounded on the North-East by 226 . 4 links of Lot 328 ; the opposite sides being parallel and equal.

Section C.

The Third Schedule.

IN THE CITY OF PERTH.

All that portion of Nelson Crescent lying between a line bearing 133° 8' from the South corner of Perth Town Lot T. 13 and the Southern side of Nile Street.

All that portion of Nile Street lying between a line hearing 177° 26' from the South- Western corner of Swan Location P. 3 and a line leaving a point on the Southern boun- dary of said Location 1,464 . 6 links from its Western extremity, and extending 161° 3', 38 . 6 links to the tangent point of a circular curve the bearing and length of whose radius are 251° 3' and 400 links from said tangent point ; thence by said curve 65 . 6 links to its intersection with the Southern boundary of said Street.

All that portion of Waterloo Crescent bounded on the South-East by the North- Western boundaries of Perth Town Lots T. 16 and T. 15 ; on the East by a line from the South-Westem corner of Swan Location P. 3 bearing 177° 2W ; on the North by the pro- duction Westward of the Southern boundary of said Location for a distance of 83.1 links, and on the North-West by a line starting from the Wr est corner of Perth Town Lot T. 16, and extending 36° 59', 200 links, to the tangent point of a circular curve the bearing and length of whose radius are 306° 59' and 631 . 1 links from said tangent point ; thence by said curve 82 . 4 links to the Western extremity of the Northern boundary.

All that portion of Trafalga:Road bounded on the South by the production We,sterly of the Southern boundary of Swan Location P. 3 for a distance of 83:1 links ; on the East by 313/8 links of the Western boundary of said location, and on the North-West by 327 . 6 links of a circular curve having a radius of 631 . 1 links which joins the Northern and Western extremities of the East and Southern boundaries respectively.

All that piece of land dedicated as a street, bounded by lines starting from a point on the Western boundary of Swan Location P. 3 situate 272 links from that location's South-Western corner, and extending 359° 46', 65 . 8 links and 89° 46', 166:6 links ; the opposite sides being parallel and equal.

All that piece of land dedicated as a way, bounded by lines starting from a point on the Southern side of Premier street 166:6 links from its intersection with the Eastern side of Trafalgar road and extending 89° 44', 30 . 3 links, and 179° 46', 181:7 links ; the opposite sides being parallel and equal.

PART 2.

All those portions of Perth Sub. Lots 403 and 410: Bounded by lines starting from a point situate 79 . 8 links South and 60 . 8 links West from the East corner of Perth Sub. Lot 403, said point being the tangent point of a circular curve the bearing and length of whose radius are 307° 58' and 74 links from said tangent point ; thence by said curve 138 . 2 links in a Northerly direction ; thence 290° 57' 1,009 . 9 links to the tangent point of a circular curve, the bearing and length of whose radius are 200° 57' and 154 . 4 links from said tangent point ; thence by said curve 117:4 links to a tangent point of a circular curve, the bearing and length of whose radius are 337° 27', and 1,681 links from said tangent point ; thence by that curve 506-1 links in a North-Easterl y direction to the tangent point of a circular curve the bearing and length of whose radius arc 230° 12' 63 . 1 links from said tangent point ; thence by that curve 66 . 9 links in a Southerly direc- tion to the tangent point of a circular curve, the bearing and length of whose radius are 110° 57' and 200 links from said tangent point ; thence by that curve 314 . 2 links ; thence 110° 57' 557:5 links to the tangent point of a circular curve the bearing and length of whose radius are 20° 57' and 200 links from said tangent point ; thence by said curve 254:8 links, and thence 217 deg. 58' 352 . 6 links to the starting point.

All those portions of lots 84,85, and 86 of Perth Sub. Lots 30,31, and Swan Location P. 3: Bounded by lines starting from a point on the Northern boundary of Nile Street situate 1,4646 links Easterly of the South-West corner of Swan Location P. 3 and ex- tending 341° 3', 681 links, to the tangent point of a circular curve the bearing and length of whose radius are 251° 3' and 200 links from the said tangent point ; thence by said curve 248 . 9 links to the Southern side of Premier Street ; thence by said side 89° 44', 3501 links ; thence 159° 0', 194:5 links ; thence 149° 11', 290 links ; thence 153° 0', 3929 links to the Northern side of Nile Street aforesaid, and thence by said side 270° 13', 334:4 links, to the starting point.

The Fourth Schedule.

Section 6.

PART I.

All that piece of land being parts of Lots 45,46, and 47 of Swan Location 64, bounded on the East by the Western boundary of Lot 44 of said Location, and on the North by 50 links of the South side of Surbiton Road ; the opposite sides being parallel and equal,

PART II.

All that portion of the Richmond Crescent bounded by lines starting from the inter- section of the Southern side of Surbiton Road with the Eastern side of Richmond Crescent, and extending in a Southerly direction along said side of Richmond Crescent for a distance of 200 . 2 links ; thence Westerly 50 links along the Southern boundary of Swan Location 64 ; the opposite sides being parallel and equal.
