P Services Ordinance 1924-1925, the Federal Capital Commission, appointed under the Seat of Government (Administration) Act 1924- 1926, hereby rnakes the following Regulations to come into .operation forthwith.

1. These Regulations may be c.ited as the Roads and Footpaths short title,
regulat ions.
| 2. I n these Regulations, unless the contrary intention appears— | Definitions. |
" L e s s e e " means lessee, under a lease for a term not less than ten years, at the time the footpath, kerb-crossing for vehicle, kerbing or guttering is being formed, or any assignee or transferee from that lessee, or if the land is not so leased at that time, the person to whom the land is first leased for ,
a term not less than ten years after the formation of the
footpath, kerb-crossing for vehicle, kerbing or gut ter ing;
" Road " means airy street, road, lane, thoroughfare or footpath,
open to, or used by, the public.
3.—(1.) The Commission' may delegate any of its powers and relegation by functions under these Regulations (except this power of delegation) commission, in relation to any matters or class of matters, so that the delegated
powers and functions may be exercised by the delegate with respect to the matters or class of matters specified in the instrument of delegation.
(2.) Every delegation under this regulation shall be revocable at will, and no delegation shall prevent the exercise of any power or function by the Commission.
| i.—(1.) | Where the Commission forms or causes to be formed, or lessee to |
has before the commencement of these Regulations formed or caused J^o't'of0" to be formed, any concrete footpath, or any kerbing or guttering on forming foot-any road, the lessee of any land adjoining the road and on the same pa
side of the road as the footpath, kerbing or guttering shall pay to the Commission that portion of one-half of the total cost of forming the footpath, kerbing or guttering which bears to one-half of the total iost the same proportion as the length of the common boundary of the road and that land bears to the aggregate length of the common boundaries of the road and all the land opposite to, and on the same side of the road as, the footpath, kerbing or guttering.

(2) For the purpose of determining any amount payable under the last preceding sub-regulation, the length of any kerbing or guttering shall include the length of all kerb-crossings for vehicles formed in conjunction therewith.
(3.) Where the Commission forms, or causes to be formed, or has before the commencement, of these Regulations, formed or caused to he formed in respect of any land, a kerb-crossing for vehicle, the lessee of that land shall, in addition to the payment required by sub-regulation (1.) of this regulation pay to the Commission one-half of the cost of forming that kerb-crossing:
Provided that if the Commission, at the request of the lessee, forms or causes to be formed, or has formed or caused to be formed, any additional kerb-crossing for vehicle in respect of the land, the lessee shall pay to the Commission the whole of the cost of forming the additional kerb-crossing:
Provided also, that, where a kerb-crossing is or has been formed
at the request of the lessee after the. completion of the formation of
the kerbing ill conjunction with which the kerb-crossing is formed,
Provided further, that if any kerb-crossing is the kerb-crossing in respect of two or more parcels of land, the payment for the kerb- crossing required by this regulation to be made to the Commission, shall be borne by the lessees of the parcels of land in equal proportions.
(4.) For the purposes of this regulation, one-half of the total cost of forming any concrete footpath, kerb-crossing,, kerbing or guttering shall be deemed to be as follows:—

(6.) For the purposes of the last preceding sub-regulation " standard kerbing and gu t t e r ing" means kerbing and guttering of one of the standard types adopted by the Commission from time to time.

5. Before the formation of any footpaths, kerb-crossings for vehicles, kerbing or guttering on any road is commenced, the Secretary to the Commission shall notify in writing each lessee of land adjoining the road of the portion of the cost payable in respect thereof by the lessee and the period within which i t is payable.
Method of payment.
6. Any amount payable in accordance with these Regulations may be paid in a lump sum or by such instalments and under such terms and conditions as the Commission determines.
Eecovery of amounts 7. Any amount due by a lessee under these Regulations shall be payatiJo. recoverable by the Commission iu any court of competent jurisdiction.
