Regulation 2010

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Roads Act 1993.

Explanatory note
The objects of this Regulation are as follows:
| (a) | to facilitate the use of an approved toll camera photograph of a trailer in prosecuting a toll offence committed by the driver of the vehicle towing the trailer, |
| (b) | to change the way in which the classes of vehicles exempt from the requirement to pay a toll for the use of the Sydney Harbour Bridge or the Sydney Harbour Tunnel are identified, |
| (c) | to apply the requirement that authorised officers of a toll operator wear a uniform and identity badge only when those officers are dealing with members of the public, |
| (d) | to omit definitions of terms that will be defined by the Roads Act 1993 (as amended by the Road Transport Legislation Amendment Act 2008). |
This Regulation is made under the Roads Act 1993 (as amended by the Road Transport Legislation Amendment Act 2008), including sections 213 (Tolls and charges for tollways) and 264 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Roads Amendment (Tollways) Regulation 2010.
2 Commencement
This Regulation commences on 13 August 2010 and is required to be published on the NSW legislation website.

[1] Clause 3 Definitions
Omit the definition of toll operator.
[2] Clause 22 Definition
Omit the definition of toll collection point.
[3] Clause 23 Driver of vehicle to pay toll
Omit “collection” from clause 23 (1).
[4] Clause 23 (6)
Insert after clause (5):
(6) In this clause:
drive a motor vehicle includes draw or tow a trailer behind a
motor vehicle.
[5] Clause 26 Objections in relation to payment of toll
Omit “collection” wherever occurring in clause 26 (2) (c), (f) and (g).
[6] Clause 43 Exempt vehicles
Omit “in Item 2, 3 or 4 of” from clause 43 (a).
Insert instead “as exempt in”.[7] Clause 82 Authorised officer
Insert “(in the case of a function exercised in the presence of a person in respect of whom it is exercised)” after “if” in clause 82 (2).
