His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Roads Act 1993.

Explanatory note
The object of this Regulation is to amend the Road Transport (Mass, Loading and
Access) Regulation 1996:
| (a) | to allow an authorised officer to direct the driver of a light vehicle (being a vehicle with a gross vehicle mass, or a combination with a gross combination mass, not exceeding 4.5 tonnes) to stop for mass checks where the officer is of the opinion that the vehicle is being used for business or commercial purposes, and |
| (b) | to allow the Roads and Traffic Authority to exempt persons from certain application fees for permits. |
This Regulation is made under the Roads Act 1993, including section 264 (the general regulation-making power) and 264A (national road transport regulations).

1 Name of Regulation
This Regulation is the Road Transport (Mass, Loading and Access)
Amendment (Vehicle Checks and Fees) Regulation 1999.
2 Amendment of Road Transport (Mass, Loading and Access) Regulation 1996
The Road Transport (Mass, Loading and Access) Regulation 1996 is amended as set out in Schedule 1.

[1] Clause 5 Application
Omit “clause 40” from clause 5 (1).
Insert instead “clauses 40 and 42”.[2] Clause 5 (5)
Insert after clause 5 (4):
(5) Clause 42 applies to:
(a) a vehicle having a GVM exceeding 4.5 tonnes, and (b) a combination, consisting of a motor vehicle connected to one or more vehicles, having a GCM exceeding 4.5 tonnes, and (c) any other vehicle that is, in the opinion of an authorised officer, being used for business or commercial purposes.
[3] Clause 41H Application fee for permit
Insert at the end of clause 41H:

The Authority may, for such reason as the Authority considers sufficient, exempt a person from the requirement to pay the fee specified in subclause (1), or waive or wholly or partly refund a fee that would otherwise be payable or has been paid in accordance with this clause.
Omit the heading to Part 6. Insert instead:
