ROADS ACT 1993—REGULATION

(Relating to evidentiary certificates issued on behalf of roads authorities)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Roads Act 1993, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 16 May 1994.

Amendment

2. The Roads (General) Transitional Regulation 1993 is amended by

omitting clause 85 and by inserting instead the following clause:

Evidentiary certificates

85. (1) For the purposes of section 248 (l), (2) and (4) of the Act, any officer of the Department of Conservation and Land Management who holds a position referred to in Schedule 3A or 3B to the Public Sector Management Act 1988 is a prescribed person in relation to the issue (on behalf of the Minister for Land and Water Conservation) of evidentiary certificates or certified copies of records, maps or plans kept by the Department.

(2) For the purposes of section 248 (l), (2) and (4) of the Act, the general manager of a council of a local government area is a prescribed person in relation to the issue of evidentiary certificates or certified copies of records, maps or plans kept by the council.

(3) An officer of the RTA specified in the Table to this clause is a prescribed person, in relation to the issue of evidentiary certificates or certified copies of records, maps or plans kept by the RTA, for the purposes of the provision so specified with respect to that officer.

EXPLANATORY NOTE

The objects of this Regulation are:

.

to prescribe thegeneralmanagerofacouncilofalocalgovernment area as a person who can issue evidentiary certificates on behalf of the council for the purposes of the Roads Act 1993; and

• to prescribe persons who can issue certified copies of records, maps and

plans kept by the RTA, roads authorities or other public authorities; and

.

toextend the list ofofficersoftheRTAwho can issue evidentiary certificates on behalf of the RTA.

This Regulation is made under the Roads Act 1993. including sections 248 and

264 (the general regulation-making power).
