ROADS ACT 1993—REGULATION

(Amendments by way of law revision)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Roads Act 1993, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation is taken to have commenced on 1 July 1993.

Amendment of Roads (Weight of Loads on Main Roads) Transitional

Regulation 1993

2. The Roads (Weight of Loads on Main Roads) Transitional Regulation 1993 is amended by omitting from clause 15 the matter “$1,500” and “$3,000” and by inserting instead the words “15 penalty units” and ‘‘30 penalty units”, respectively.

Amendment of amending Regulation of 1 July 1993

3. The Regulation made under the Roads Act 1993 and published in Gazette No. 73 of 1 July 1993 at pages 3582–3590 is amended by omitting clause 5 (h).

EXPLANATORY NOTE

The object of this Regulation is to ensure that references to monetary penalties in the Roads (Weight of Loads on Main Roads) Transitional Regulation 1993 (previously Ordinance No. 30C under the Local Government Act 1919) are expressed in penalty units rather than in money amounts.

This Regulation is made under the Roads Act 1993, including section 264 (the general regulation making power) and clause 1 of Schedule 2 (which empowers the regulations to make provision of a savings or transitional nature).
