Explanatory note

The object of this Regulation is to enable an individual to apply for the waiver of half of the individual’s registration fee in respect of a single light motor vehicle payable in a financial year if the individual has paid $780 (including GST) in tolls during the previous financial year.

Current exemptions from the requirement to pay the fee will continue to be available (as a waiver of the whole fee, instead of an exemption) to individuals who pay $1,300 (including GST) or more in tolls.

This Regulation is made under the Road Transport Act 2013, including sections 21, 23 (the general statutory rule-making power) and 24 and clause 14 of Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport (Vehicle Registration) Amendment (Toll

Relief Scheme) Regulation 2019.

2      Commencement

This Regulation commences on 20 May 2019 and is required to be published on the
NSW legislation website.

Omit “Applications to claim exemptions” from the heading to clause 127A (1).

Insert instead “Application for waiver”.

[12]      Clause 127A (8) (a) and (aa)

Omit clause 127A (8) (a). Insert instead:

(a) if the previous financial year is the 2017–2018 financial year and the application relates to the waiver of all of a fee—$1,300 (inclusive of GST), or
(aa) if the previous financial year is the 2018–2019 financial year:
(i) for an application relating to the waiver of all of a fee—$1,300 (inclusive of GST), or
(ii) for an application relating to the waiver of half of a fee—$780 (inclusive of GST), or

Omit “exemptions can only be claimed”.

Insert instead “applications for a waiver can only be made”.

Omit “an exemption is claimed”. Insert instead “an application for a waiver is made”.

(11A) An amendment made to this clause by the Road Transport (Vehicle

affect any entitlement to claim an exemption, or any exemption granted, under this clause as in force immediately before the commencement of that Regulation.
