Explanatory note
The object of this Regulation is to amend the Road Transport (Vehicle Registration) Regulation 2007 to authorise Roads and Maritime Services to release certain vehicle registration information to the State Insurance Regulatory Authority (SIRA) for the purpose of SIRA exercising its functions under the State Insurance and Care Governance Act 2015.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 64 (3).

1      Name of Regulation

This Regulation is the Road Transport (Vehicle Registration) Amendment (SIRA)
Regulation 2016.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Road Transport (Vehicle Registration) Regulation 2007

Clause 14G

Insert after clause 14F:

14G Release of information in Register to SIRA

(1)

The Authority may enter into an agreement with SIRA (a SIRA registration information disclosure agreement) that provides for the release to SIRA of the relevant information with respect to a registrable vehicle for the purpose of enabling SIRA to exercise the functions conferred on it by section 24 of the State Insurance and Care Governance Act 2015.

(2)

The Authority is authorised to release the relevant information in accordance with the SIRA registration information disclosure agreement.

(3)

A SIRA registration information disclosure agreement may provide for the payment of fees by SIRA to the Authority in connection with the agreement, including fees for the release of relevant information in accordance with the agreement.

(4) In this clause:
SIRA means the State Insurance Regulatory Authority constituted
under the State Insurance and Care Governance Act 2015.
relevant information, with respect to a registrable vehicle, means the
following information:
(a) any information recorded on the Register,
(b) the date of birth of any registered operator or former registered operator of the vehicle.
