Road Transport (Vehicle Registration) Amendment (Release of Information to Toll Operators) Regulation 2012

His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Vehicle Registration) Act 1997.

Explanatory note
The object of this Regulation is to enable Roads and Maritime Services (the Authority) to enter into agreements with other toll operators that authorise the release to those toll operators of the name and address of a registered operator of a vehicle and the identification details of the vehicle. The Authority will be required to consult with the Privacy Commissioner before entering into such an agreement.

This Regulation is made under the Road Transport (Vehicle Registration) Act 1997, including sections 10 (3) and 14 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Road Transport (Vehicle Registration) Amendment (Release of Information to Toll Operators) Regulation 2012.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

Clause 14A

Insert after clause 14:

14A Release of information in Register to toll operators

(1)

The Authority may enter into an agreement with a toll operator (a registration information disclosure agreement) that provides for the release to the toll operator of registration information with respect to a registrable vehicle.

(2)

The Authority must consult with the Privacy Commissioner before entering into a registration information disclosure agreement.

(3)

The Authority is authorised to release registration information in the Register in accordance with a registration information disclosure agreement.

(4)

A registration information disclosure agreement may provide for the payment of fees by a toll operator to the Authority in connection with the agreement, including fees for the release of information in accordance with the agreement.

(5) In this clause:
registration information, with respect to a registrable vehicle,
means the following information recorded in the Register:

(a)

the name, residential address and address for the service of notices (if any) of any registered operator of the vehicle, and

(b) the identification details of the vehicle.

toll operator means a toll operator under the Roads Act 1993,
other than the Authority.
