Road Transport (Vehicle Registration) Amendment (Point to Point Transport) Regulation 2017

The Administrator, with the advice of the Executive Council, has made the following Regulation under the Road Transport Act 2013.

Explanatory note

The object of this Regulation is to amend the Road Transport (Vehicle Registration) Regulation 2017 as follows:

(a) to remove the requirement for vehicles regulated under the Point to Point Transport (Taxis and Hire

Vehicles) Act 2016, and seating more than 8 but fewer than 12 persons, to undergo vehicle

inspections at least twice a year,

(b) to update the references in the Regulation to taxis as a consequence of the commencement of the provisions of the Point to Point Transport (Taxis and Hire Vehicles) Act 2016 regulating taxis and hire vehicles.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 24 and Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport (Vehicle Registration) Amendment (Point to
Point Transport) Regulation 2017.

2      Commencement

This Regulation commences on 1 November 2017 and is required to be published on the NSW legislation website.

3 Amendment of Road Transport (Vehicle Registration) Regulation 2017

(1) Clause 67 Periodic inspections

Omit “public passenger vehicle” wherever occurring. Insert instead “bus”.

(2) Clause 67 (4)
Insert after clause 67 (3):
(4) In this clause:
bus means:

(a)

a public passenger vehicle that is equipped to seat more than 12 adults, or

(b)

a public passenger vehicle that is equipped to seat 12 or fewer adults and is taken to be, or is, used for the purposes of a public passenger service within the meaning of the Passenger Transport

Act 1990 or the Passenger Transport Act 2014.

(3) Dictionary
Omit the definition of taxi. Insert instead:

taxi has the same meaning as in the Point to Point Transport (Taxis and
Hire Vehicles) Act 2016.
