His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport Act 2013.

Explanatory note
Motor regulation-making power).
The object of this Regulation is to update certain references and terminology as a consequence of the
Dealers and Repairers Act 2013.

1      Name of Regulation

This Regulation is the Road Transport (Vehicle Registration) Amendment (Law
Revision) Regulation 2015.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

Schedule 1 Amendment of Road Transport (Vehicle
Registration) Regulation 2007

[1]      Clauses 32 (4) (b) (i) and (c), 33 (2) and 44 (1) (a)

Omit “dealer” wherever occurring. Insert instead “motor dealer”.

[2]      Clause 32 Obligations of disposers: provision of inspection reports

Omit “section 23B or 23C of the Motor Dealers Act 1974” from clause 32 (4) (b) (ii).
Insert instead “section 57 or 59 of the Motor Dealers and Repairers Act 2013”.

[3]      Clause 32 (4) (b) (iii)

Omit the subparagraph. Insert instead:

(iii)      to a motor vehicle recycler licensed under the Motor Dealers and Repairers Act 2013 for the purpose of demolishing or dismantling the vehicle,

[4]      Clauses 32 (4) (d), 83L (Prescribed information about vehicles disposed of to motor vehicle recycler) and 83M

Omit “an auto-dismantler” wherever occurring. Insert instead “a motor vehicle recycler”.

Insert instead “Motor Dealers and Repairers Act 2013”.

[7]      Clause 83M Prescribed information about demolished or dismantled vehicles

Omit “the auto-dismantler’s” from clause 83M (c).
Insert instead “the motor vehicle recycler’s”.

[8]      Dictionary

Omit the definition of dealer. Insert in alphabetical order:

motor dealer, in relation to a vehicle, means the holder of a motor dealer’s
licence under the Motor Dealers and Repairers Act 2013.
motor vehicle recycler has the same meaning as in Part 4.5 of the Act.
