Explanatory note
The object of this Regulation is to amend the Road Transport (Vehicle Registration) Regulation 2007 to apply certain vehicle standards relating to the display and illumination of number-plates to the display and illumination of auxiliary number-plates and to make other miscellaneous amendments.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 24 and Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport (Vehicle Registration) Amendment (Auxiliary
Number-plates) Regulation 2016.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

Schedule 1 Amendment of Road Transport (Vehicle
Registration) Regulation 2007

[1]      Clause 14E Release of information for searches

Omit “the plate number” from paragraph (a) of the definition of vehicle information in clause 14E (2).

Insert instead “the registration number”.

[2]      Clause 17 Definition

Omit the definitions of number, number-plate and vehicle number-plate.

[3]      Clause 21 Auxiliary number-plates

Omit clause 21 (1) and (2). Insert instead:

(1) The Authority may, on the payment of the applicable fee, issue an auxiliary number-plate (in addition to any vehicle number-plates) bearing the registration number assigned to the motor vehicle for which it is issued.
Note. Clause 19 requires the Authority to assign a distinguishing registration number to any motor vehicle that is registered (conditionally or otherwise) by the Authority. See clause 13 for conditional registration.

[4]      Clause 21A Display of auxiliary number-plates

Omit clause 21A (2) and (3).

[5]      Clause 33 Obligations of disposers: application for transfer of registration and notification to Authority

Omit clause 33 (2) (c). Insert instead:

(c) the registration number of the vehicle.

[6]      Clause 36 Registration of the transfer of vehicles and functions of the Authority

Omit “the distinguishing number of the registration” from clause 36 (2) (a).
Insert instead “the registration number”.

[7]      Clause 43 Issue of unregistered vehicle permits

Omit clause 43 (1).

[8]      Clause 85 Number-plate and registration certificate and label offences

Insert at the end of clause 85 (2) (b) (ii):

, or

(c) an auxiliary number-plate otherwise than in accordance with clause 21A.

[9]      Schedule 2 Vehicle standards

Omit clauses 60 (1) and 61 (1).

[10]      Schedule 2, clause 61 (4) (b)

Omit “so far as practicable”. Insert instead “so far as is practicable”.

[11]      Schedule 2, clause 61 (5) and (6)

Omit clause 61 (5). Insert instead:

(5) Subclause (2) (b) and (c) do not apply to the rear vehicle number-plate of a motor vehicle if an auxiliary number-plate issued for the motor vehicle is displayed, in accordance with clause 21A, at the rear of the vehicle in a manner that complies (as far as is practicable) with subclause (2) (a)–(d).
Note. Clause 21A (1) of this Regulation sets out the circumstances in which an auxiliary number-plate may be displayed.
(6) This clause does not apply to a tow truck that is displaying a number-plate in
accordance with clause 47 of the Tow Truck Industry Regulation 2008.
Note. If the number-plate of a tow truck is likely to be obscured by a motor vehicle that is to be towed by the tow truck, clause 47 of the Tow Truck Industry Regulation 2008 requires that the driver of the tow truck display the number-plate at the rear of the towed vehicle or in such other manner that the number-plate remains clearly visible.

[12]      Schedule 2, clause 99 (2)

Omit “(other than an auxiliary number-plate)” from clause 99 (2).

[13]      Schedule 2, clause 99 (4)

Insert after clause 99 (3):

(4) Subclauses (2) and (3) apply to a number-plate light used to illuminate an auxiliary number-plate issued in respect of a vehicle as if the auxiliary number-plate were a number-plate on the rear of the vehicle.

[14]      Dictionary

Insert in alphabetical order:

number includes a letter of the alphabet.
number-plate means a number-plate issued under this Regulation.
vehicle number-plate means a number-plate other than an auxiliary
number-plate.
