Regulation 2000

Road Transport (Vehicle Registration) Act 1997

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Vehicle Registration) Act 1997.

Explanatory note
The objects of this Regulation are:

(a)

to provide for the kinds of flashing lights that certain emergency and rescue vehicles may display, and

(b)

to enable police officers to require certain persons to present registrable vehicles for inspection by the Roads and Traffic Authority or authorised examiners, and

(c)

to omit appeal rights that have been superseded by provisions in Division 2 of Part 1 of Schedule 2 to the Road Transport (General) Regulation 1999, and

(d) to make some amendments in the nature of law revision.

This Regulation is made under the Road Transport (Vehicle Registration) Act

1997, including sections 14 (the general regulation-making power) and 15A.

1      Name of Regulation

This Regulation is the Road Transport (Vehicle Registration)

Amendment (Miscellaneous) Regulation 2000.

2 Commencement

This Regulation commences on 1 July 2000.

3 Amendment of Road Transport (Vehicle Registration) Regulation 1998

The Road Transport (Vehicle Registration) Regulation 1998 is amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

(Clause 3)

[1]      Clause 61 Inspection of vehicles

Insert “or a police officer” after “Authority” where firstly occurring.

[2]      Clause 61 (2) and (3)

Insert “or police officer” after “Authority” wherever occurring.

[3]      Clause 69 Notification of decisions by Authority

Omit “subclause (3)” from clause 69 (6). Insert instead “subclause (4)”.

[4]      Clause 69 (6) and (8)

Omit “clause 70” wherever occurring.
Insert instead “Division 2 of Part 1 of Schedule 2 to the Road Transport
(General) Regulation 1999”.

[5]      Clauses 70 and 71

Omit the clauses.

[6]      Schedule 4 Vehicle standards

Omit clause 123 (5) (a) and (b). Insert instead:

(a)

in the case of a police vehicle, ambulance or fire fighting vehicle—a blue or red light, or

(b)

in the case of a Red Cross vehicle, a mines rescue or other rescue vehicle or an emergency vehicle within the meaning of the Australian Road Rules (other than a vehicle referred to in paragraph (a))—a red light, or

Insert in clause 1 in alphabetical order:

Australian Road Rules has the same meaning as it has in the Road Transport (Safety and Traffic Management) (Road Rules) Regulation 1999.

[8]      Dictionary, definition of “personally imported vehicle”

Omit “with” from paragraph (c) of the definition in clause 1.
Insert instead “within”.
