ROAD TRANSPORT (VEHICLE REGISTRATION) ACT 1997

NO 119—PROCLAMATION

(L.S.) GORDON SAMUELS, Governor.

I, the Honourable Gordon Samuels AC, Governor of the State of New South
Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Road Transport (Vehicle Registration) Act 1997, do, by this my Proclamation, appoint 29 June 1998 as the day on which that Act commences, except for the following:

(a) so much of Schedule 1 [3] as omits section 3 (1) (q11) and (q12) of the Traffic Act 1909,
(b) so much of Schedule 1 [10] as omits section 11C of the Traffic Act

1909,

(c) Schedule 1 [ 1 3 ] .

EXPLANATORY NOTE

The object of this proclamation is to commence all the provisions of the Road
Transport (Vehicle Registration) Act 1997 with 3 exceptions.
The provisions that will remain uncommenced deal with the following:

( a ) the repeal o f regulation-making powers in the Traffic Act1909 concerning the

designation and treatment o f persons as owners of vehicles for the purposes of section 18A (Liability of motor vehicle owner for designated offences) of that Act,

(b)

the repeal of certain paragraphs of the definition of owner in section 18A of that Act, including a paragraph referring to regulations made under those regulation-making powers,

( c )

the repeal of section 11C, which provides for the seizure of number-plates by police officers and persons authorised by the Roads and Traffic Authority.
