Road Transport (Safety and Traffic

Management) Amendment (TFMS Fee
and Tow-away Charge) Regulation

Road Transport (Safety and Traffic Management) Act 1999

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Safety and Traffic Management) Act 1999.

Explanatory note
The objects of this Regulation are:

(a)	to amend the Road Transport (Safety and Traffic Management) (Driver Fatigue) Regulation 1999 to increase from $58 to $59 the fee for the registration of an applicant as a participant in the Transitional Fatigue Management Scheme (TFMS) for heavy truck drivers and the employers of heavy truck drivers, and
(b)	to amend the Road Transport (Safety and Traffic Management) (Road Rules) Regulation 1999 to increase from $144 to $148 the tow-away charge for the removal of unattended motor vehicles or trailers.

The TFMS fee and tow-away charge are increased in line with movements in the Consumer
Price Index.
This Regulation is made under the Road Transport (Safety and Traffic Management) Act
1999, including section 71 (the general regulation-making power) and, in particular, section

71 (11) and section 76 (5) and clauses 4 and 9 of Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport (Safety and Traffic Management) Amendment (TFMS Fee and Tow-away Charge) Regulation 2005.

2      Commencement

This Regulation commences on 1 July 2005.

3 Amendment of Road Transport (Safety and Traffic Management) (Driver Fatigue) Regulation 1999

The Road Transport (Safety and Traffic Management) (Driver Fatigue) Regulation 1999 is amended by omitting from Schedule 1 the matter “$58” and by inserting instead the matter “$59”.

4 Amendment of Road Transport (Safety and Traffic Management) (Road Rules) Regulation 1999

The Road Transport (Safety and Traffic Management) (Road Rules) Regulation 1999 is amended by omitting from clause 155 (2) the matter “$144” and by inserting instead the matter “$148”.
