  1. Name of regulation

    This regulation is the Road Transport (Safety and Traffic Management) Amendment Regulation 2016 (No 1).

  2. Commencement

    This regulation commences on 1 July 2016.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Road Transport (Safety and Traffic Management) Regulation 2000.

    NoteThis regulation also amends the Road Transport (Offences) Regulation 2005 (see s 9 and s 10).

  4. New section 13BA

    insert

13BAARR r 189—double parking—motorbikes

Despite the Australian Road Rules, rule 189 (1), the rider of a motorbike may stop on the road with part of the motorbike between another motorbike that is parked on the road and the centre of the road if both motorbikes are parked within the same parking bay.

  1. New section 44 (2A)

    insert

    (2A)Subsection (2) does not apply to the rider of a motorbike if the other vehicle is also a motorbike.

  2. New section 44AA

    after section 44, insert

44AAMetered parking—parking in spaces—motorbikes

(1)The rider of a motorbike commits an offence if—

(a)the rider parks the motorbike in a metered parking space; and

(b)there are more than 2 other motorbikes already parked in the space.

Maximum penalty:  20 penalty units.

(2)The rider of a motorbike commits an offence if—

(a)the rider parks the motorbike in a metered parking space; and

(b)another motorbike is already parked in the space; and

(c)the rider parks the motorbike in a position that unreasonably obstructs the path of the other motorbike out of the space.

Maximum penalty:  20 penalty units.

  1. New section 49 (3A)

    insert

    (3A)Subsection (3) does not apply to the rider of a motorbike if the other vehicle is also a motorbike.

  2. New section 49AAA

    after section 49, insert

49AAATicket parking—parking in spaces—motorbikes

(1)The rider of a motorbike commits an offence if—

(a)the rider parks the motorbike in a ticket parking space; and

(b)there are more than 2 other motorbikes already parked in the space.

Maximum penalty:  20 penalty units.

(2)The rider of a motorbike commits an offence if—

(a)the rider parks the motorbike in a ticket parking space; and

(b)another motorbike is already parked in the space; and

(c)the rider parks the motorbike in a position that unreasonably obstructs the path of the other motorbike out of the space.

Maximum penalty:  20 penalty units.
