Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Safety and Traffic Management) Act 1999.

Explanatory note
The object of this Regulation is to provide that electronic parking permits (being parking
permits in electronic form) may be issued by a parking authority in respect of a vehicle.
This Regulation is made under the Road Transport (Safety and Traffic Management)

Act 1999, including section 71 (the general regulation-making power) and Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport (Safety and Traffic Management) Amendment (Electronic Parking Permits) Regulation 2012.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Clause 124 Parking permits

Omit clause 124 (3). Insert instead:

(3) A parking authority may issue a permit under this clause in
electronic or printed form.
(3A) A permit must specify the parking area or road to which it
applies, the conditions to which it is subject and:
(a) in the case of a resident’s visitor parking permit that is a printed parking permit—the address of the resident who holds the permit, or
(b) in the case of any other permit—the registration number of the vehicle to which it relates.
(3B) The Authority may issue guidelines from time to time for or with respect to the issuing of printed parking permits and electronic parking permits.

Insert in alphabetical order:

electronic parking permit means a permit issued under this
clause that is in electronic form.

parking space means any of the following:

(a) coupon parking space,
(b) permissive parking space,
(c) meter parking space,
(d) ticket parking space,
(e) phone parking space.

permissive parking space means a parking bay that is indicated
by studs, pads, plates or strips.
printed parking permit means a permit that is issued under this
clause in printed form.
