Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Safety and Traffic Management) Act 1999.

Explanatory note
Under the Road Transport (Safety and Traffic Management) Act 1999 bodies prescribed as declared organisations are parking authorities and may establish parking schemes within their area of operation.
The objects of this Regulation are:

(a) to prescribe the Hunter New England Area Health Service as a declared organisation in respect of Rankin Park campus, James Fletcher Hospital, Belmont Hospital, Wallsend campus, Maitland Hospital, Waratah campus and Tamworth Base Hospital, and
(b) to make it clear that a declared organisation must be a body constituted by or under an Act or a Government Department.

This Regulation also allows certain authorised officers under Part 8 of the Road Transport (General) Regulation 2005 to direct the person in charge of a vehicle displaying a mobility parking scheme authority to give the scheme authority to the officer and to inspect the scheme authority, request and inspect the identification of the person and, in certain circumstances, to confiscate the scheme authority.

This Regulation is made under the Road Transport (Safety and Traffic Management) Act 1999, including section 71 (the general regulation-making power) and, in particular, clause 2 (a) of Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport (Safety and Traffic Management) Amendment (Declared Organisations) Regulation 2010.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Clause 3 Definitions

Omit “an organisation” from the definition of declared organisation in clause 3 (1).

Insert instead “a body constituted by or under an Act or a Government
Department”.

[2]      Clause 117 Disputes

Omit clause 117 (3) (c). Insert instead:

(c) in the case of a Government Department, the Minister responsible for that Department.

[3]      Clause 126N Production and confiscation of scheme authorities

Omit paragraph (b) from the definition of authorised officer in clause 126N (3).

Insert instead:

(b) an authorised officer within the meaning of Part 8 of the Road Transport (General) Regulation 2005, other than an officer referred to in Schedule 2 of that Regulation as class 3 officer or a class 4 officer.
