His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Safety and Traffic Management) Act 1999.

Explanatory note
The object of this Regulation is to enable the Roads and Traffic Authority to exempt certain classes of motor vehicle from a provision of the Australian Road Rules that requires the driver of a motor vehicle to switch off the vehicle’s engine and remove the ignition key before leaving the vehicle.

This Regulation is made under the Road Transport (Safety and Traffic Management) Act 1999, including section 71 (the general regulation-making power) and Schedule 1.

1     Name of Regulation

This Regulation is the Road Transport (Safety and Traffic Management) (Road Rules) Amendment (Motor Vehicle Security) Regulation 2000.

Insert after clause 22:

22A Exemption from certain motor vehicle security requirements

(1)

The Authority may, by order in writing, exclude any class of motor vehicles from the operation of rule 213 (3) (a) and (4) (a) of the Australian Road Rules if it is satisfied:

(a)

that such vehicles are used for the purpose of delivering or collecting goods (including money) in circumstances that require the drivers of those vehicles to enter and leave those vehicles at frequent intervals, and

(b)

that the engines of such vehicles have to be kept running in order to operate equipment used in connection with the use of those vehicles for that purpose.

(2) Such an order may be made subject to such conditions as the
Authority considers appropriate.

(3)

For the purposes of rule 213 (2) of the Australian Road Rules, the driver of a vehicle to which an order under this clause applies is exempt from the operation of rule 213 (3) (a) and (4) (a) of the Australian Road Rules so long as the driver complies with any condition to which the order is subject.
