This regulation may be cited as the Road Transport Reform Regulation 1999 . ˙ Commencement 2.(1) Section 3 and schedule 1 commence on 22 November 1999. (2) Section 4 and schedule 2 commence on 1 December 1999. ˙ Schedule 1 amendments 3. Schedule 1 amends the subordinate legislation it mentions. ˙ Schedule 2 amendments 4. Schedule 2 amends the subordinate legislation it mentions.

Schedule 1, part 45A, table, entries for sections 32(3), 33(4), 37(2), 38(3) and 39(3), ‘12’— omit, insert— ‘20’. 2. Section 26(b)— omit, insert— ‘(b) a liability offence for the Act, section 57; and (c) an extended liability offence for the Act, section 57B.’. 5. Schedule 13— insert— ‘ “dangerous overloading offence” means an offence committed when a vehicle is loaded to at least 120% but less than 160% of a mass requirement that applies to the vehicle. “excessive overloading offence” means an offence committed when a vehicle is loaded to more than 100% but less than 120% of a mass requirement that applies to the vehicle. “extreme overloading offence” means an extreme overloading offence under section 79N of the Act.’.

Part 2, division 2— omit, insert — ‘ Division 2—Local law offences and minor traffic offences ‘ Infringement notice offences and penalties for local laws ‘ 6A. For part 4A of the Act— (a) an offence against a local law is an infringement notice offence; and (b) the infringement notice penalty for the infringement notice offence under an infringement notice is the amount worked out under schedule 1A for the offence. ‘ Administering authority for local laws ‘ 6B. The administering authority for an infringement notice and an infringement notice offence under section 6A is the chief executive officer of the local government that made the local law.

The person authorised to serve an infringement notice under section 98C 1 of the Act for an infringement notice offence under section 6A or the TransportOperations(RoadUseManagement)Act1995 , section 108 is an authorised person under the Local Government Act 1993 , section 1084. 2 ‘ Authorised person for reminder notice, enforcement notice and withdrawal from acting under the Act, pt 4A, div 3 ‘ 6D.(1) The person authorised to— (a) serve a reminder notice; and (b) give an enforcement notice; and (c) withdraw from acting under part 4A, division 3 3 of the Act; for an infringement notice offence under section 6A is the chief executive officer of the local government that made the local law. ‘ (2) The person authorised to— (a) serve a reminder notice; and (b) give an enforcement notice; and (c) withdraw from acting under part 4A, division 3 of the Act; for an infringement notice offence under the TransportOperations(RoadUse Management) Act 1995 , section 108 is the chief executive officer of the local government that prescribed an amount as the infringement notice penalty for the minor traffic offence that, under the section, is the infringement notice offence.’. 1 Section 98C of the Act deals with the service of infringement notices generally. 2 Local Government Act 1993 , section 1084 (Appointment). 3 Part 4A, division 3 of the Act deals with the enforcement of infringement notices by registration.
