An Act to amend the Road Transport (Public Passenger Services) Act 2001 and the Road Transport (Public Passenger Services) Regulation 2002, and for other purposes

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Part 1Preliminary

  1. Name of Act

    This Act is the Road Transport (Public Passenger Services) Amendment Act 2025.

  2. Commencement

    This Act commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This Act amends the following legislation:

    ·     Road Transport (Public Passenger Services) Act 2001

    ·     Road Transport (Public Passenger Services) Regulation 2002.

    NoteThis Act also amends the Road Transport (Offences) Regulation 2005 (see sch 1).

Part 2Road Transport (Public Passenger Services) Act 2001

  1. New section 27AA

    in division 2.5, insert

27AARegulations about bus stops and surrounding areas

A regulation may make provision in relation to—

(a)the conduct of people at bus stops and areas surrounding bus stops for the purpose of safety; and

(b)the authority of police officers and authorised people to direct people contravening a regulation to leave a bus stop or a stated area surrounding the bus stop; and

(c)the authority of police officers to remove people from a bus stop or surrounding area if they fail to comply with a direction to leave the bus stop or surrounding area.

Part 3.3Bus passengers and people in bus stop areas

  1. New section 51A

    in part 3.3, insert

51AMeaning of bus stop area—pt 3.3

(1)In this part:

bus stop area means the area within a 20m radius of a bus stop sign that is public unleased land.

(2)In this section:

bus stop sign—see section 70 (2).

public unleased land—see the Public Unleased Land Act 2013, section 8.

  1. Behaviour that interferes with comfort or safety
    New section 52 (3A) and (3B)

    insert

    (3A)A person commits an offence if the person—

    (a)is in a bus stop area; and

    (b)    behaves in an aggressive or menacing way.

    Maximum penalty:  10 penalty units.

    (3B)A person commits an offence if the person—

    (a)is in a bus stop area; and

    (b)unreasonably interferes with the safety of someone else.

    Maximum penalty:  10 penalty units.

    in part 3.3, insert

67AAPolice officer or authorised person—power to direct person to leave bus stop area

(1)A police officer or authorised person may direct a person to leave a bus stop area if the police officer or authorised person believes on reasonable grounds that the person is committing, or has just committed, an offence against section 52 (2) (b) (iii), (3A) or (3B).

(2)The police officer or authorised person who gives a person a direction must tell the person the bus stop area to which the direction applies.

(3)A person commits an offence if the person—

(a)is given a direction under subsection (1); and

(b)fails to comply with the direction.

Maximum penalty:  5 penalty units.

(4)An offence against this section is a strict liability offence.

67ABPolice officer—power to remove person from bus stop area

A police officer may remove a person from a bus stop area if the person—

(a)is given a direction under section 67AA; and

(b)fails to comply with the direction.
