Regulation 1998

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Roads Act 1993.

Explanatory note

The objects of this Regulation are:

(a)

to enable notices to be issued that exempt oversized special purpose vehicles (for example, mobile cranes, concrete pumps and travel towers) from having to comply with certain dimension limits when they are standing and operating on a road or road related area, and

(b)

to clarify certain terminology relating to vehicles or combinations that exceed mass or dimension limits.

This Regulation is made under the Roads Act 1993, including section 264 (the general regulation-making power) and 264A (matters referred to in national road transport regulations).

1 Name of Regulation

This Regulation is the Road Transport (Mass, Loading and

Access) Amendment (Dimensions) Regulation 1998.

2 Amendment of Road Transport (Mass, Loading and Access) Regulation 1996

The Road Transport (Mass, Loading and Access) Regulation

1996 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Clauses 10, 12 (1) and (3) , 13 (1) (a) and 36 (2)

Omit “or combination” and “or combinations” wherever occurring.

[2 ]        Clause 10 (2) and (3)

Insert at the end of clause 10:

The Authority may, by notice published in the Gazette, also exempt Class 1 special purpose vehicles from the dimension limits in Table 3 of clause 2 of Schedule 2 while standing and operating.

(3)

For the purposes of subclause (2), a special purpose vehicle is standing and operating if it is being used for the purpose for which it is designed, and that use requires the special purpose vehicle to stand in a stationary position, or to move between closely proximate positions.

[ 3 ]        Clause 11 What must be included in a Class 1 notice?

Omit clause 11 (1) (a). Insert instead:

(a)

in the case of a notice made under clause 10 (1),

the Class 1 vehicles to which i t applies, and

(a1)

in the case of a notice made under clause 10 (2),

the special purpose vehicles to which i t applies,

and

Omit the paragraph. Insert instead:

( c )

the provisions of this Regulation and the Motor Traffic Regulations 1935 from which exemption is given, and

The conditions of a Class 1 notice that is made under clause 10 (1) must include the conditions set out in Schedule 2 that apply to the Class 1 vehicles to which the notice applies.
