Road Transport Legislation Amendment

(Road Rules) Regulation 2014

Regulation under the Road Transport Act 2013.

Explanatory note
The object of this Regulation is to amend certain Acts and statutory rules to update references to the Road Rules 2008 and make other consequential amendments as a consequence the repeal of those Rules and replacement by the Road Rules 2014 on 1 December 2014.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power), 24, 32 and 195 and clause 16 of Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport Legislation Amendment (Road Rules)
Regulation 2014.

2      Commencement

This Regulation commences on 1 December 2014 and is required to be published on the NSW legislation website.

Schedule 1 Amendments updating references to Road Rules
2008

Each Act and statutory rule specified in Column 1 of the following Table of amendments is amended:

(a)

by omitting “Road Rules 2008” wherever occurring in the provision (including headings and notes) of the Act or statutory rule concerned specified in Column 2 of the Table, and

(b) by inserting instead “Road Rules 2014”.

Insert after the matter relating to rule 195 (1) of the Road Rules 2008:

[1]      Clause 3 Definitions

Insert in alphabetical order in clause 3 (1):

ordinary metered parking area has the same meaning as in rule 207–1 of the
Road Rules 2014.
registration metered parking area has the same meaning as in rule 207–1 of
the Road Rules 2014.

[2]      Clause 62 Parking meters

Insert at the end of clause 62 (1) (c):

, and

(d) in the case of a metered parking space for a registration metered parking area—that the registration number of the vehicle must be entered for use of the parking space.

[3]      Clause 62 (2)

Omit the subclause. Insert instead:

(2) A parking meter must clearly show the status of the metered parking space or
spaces that it controls and:
(a) in the case of a multi-space parking meter in an ordinary metered parking area—must identify each metered parking space by its number, or
(b) in the case of a multi-space parking meter in a registration metered parking area—must indicate the registration number of each vehicle parked in a metered parking space controlled by the parking meter.

[4]      Schedule 5 Penalty notice offences

Omit “Rule 267–1 (3);” from the matter relating to the Road Rules 2008.
Insert instead “Rule 267–1 (4);”.
