Regulation under the Road Transport Act 2013.

Explanatory note

The object of this Regulation is to amend the Road Transport (Driver Licensing) Regulation 2017 to enable Roads and Maritime Services to provide driver licence numbers to toll operators for the purposes of collecting unpaid tolls and charges.

The Regulation also amends the Road Transport (Vehicle Registration) Regulation 2017 to permit the release of additional registration information to toll operators.

This Regulation is made under the Road Transport Act 2013, including sections 23 and 30.

1      Name of Regulation

This Regulation is the Road Transport Legislation Amendment (Release of

Information to Toll Operators) Regulation 2018.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Road Transport (Driver Licensing) Regulation 2017

Clause 104A

Insert after clause 104:

104A	Release of information to toll operators
(1) The Authority may, in connection with the release of information to a toll operator under clause 133 of the Road Transport (Vehicle

Registration) Regulation 2017, provide the driver licence number of a

registered operator of a vehicle to the toll operator for the purposes of enabling the toll operator to recover an unpaid toll or charge from the registered operator.

(2)	In this clause, toll operator means a toll operator under the Roads Act
1993 other than the Authority.

4 Amendment of Road Transport (Vehicle Registration) Regulation 2017

(1) Clause 133 Release of information in Register to toll operators

Insert “date of birth, date of death (if applicable),” after “name,” in paragraph (a) of the definition of registration information in clause 133 (5).

Insert after paragraph (a):

(a1) any other contact details for the registered operator of the vehicle,
