Part 1Preliminary
Name of regulation
This regulation is the Road Transport Legislation Amendment Regulation 2011 (No 2).
Commencement
This regulation commences on a day fixed by the Minister by written notice.
Note 1The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Note 2A single day or time may be fixed, or different days or times may be fixed, for the commencement of different provisions (see Legislation Act, s 77 (1)).
Note 3If a provision has not commenced within 6 months beginning on the notification day, it automatically commences on the first day after that period (see Legislation Act, s 79).
Legislation amended
This regulation amends the following legislation:
· Road Transport (Driver Licensing) Regulation 2000
· Road Transport (Public Passenger Services) Regulation 2002.
Part 2Road Transport (Driver Licensing) Regulation 2000
New section 62 (3) (ha)
insert
(ha)for a public vehicle licence for a taxi—the person is certified by a registered training organisation as meeting the national minimum English standard for taxi drivers; and
New section 62 (5) and (6)
insert
(5)In this section:
national minimum English standard, for taxi drivers, means the following levels of English language proficiency under the International Second Language Proficiency Ratings (ISLPR): General Proficiency Version for English, 2010 edition (the ISLPR):
(a)listening—3;
(b)speaking—2+;
(c)reading—2;
(d)writing—1+.
NoteThe ISLPR does not need to be notified under the Legislation Act because s 47 (5) does not apply (see Legislation Act, s 47 (7)). The ISLPR is accessible at training organisation—see the Training and Tertiary Education Act 2003, dictionary.
(6)The Legislation Act, section 47 (5) does not apply to the ISLPR.
NoteThe text of an applied, adopted or incorporated law or instrument, whether applied as in force from time to time or at a particular time, is taken to be a notifiable instrument if the operation of the Legislation Act, s 47 (5) or (6) is not disapplied (see s 47 (7)).
