Road Transport Legislation Amendment

(Fees, Penalty Levels and Charges)

Regulation 2014

Road Transport Act 2013

His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport Act 2013.

Explanatory note
The objects of this Regulation are as follows:

(a) to amend the Road Transport (Driver Licensing) Regulation 2008 to increase certain fees payable in connection with driver licensing,
(b) to amend the Road Transport (General) Regulation 2013:
(i) to increase the penalty levels for penalties for motor vehicle offences that are dealt with by way of penalty notices issued under the Road Transport Act 2013, and
(ii) to increase from $183 to $188 the tow-away charge for the removal of unattended motor vehicles or trailers, and
(iii) to increase from $19 to $20 the daily storage fee for an impounded motor vehicle,
(c) to amend the Road Transport (Mass, Loading and Access) Regulation 2005 to decrease from $76 to $70 the fee for a permit exempting a person from restrictions on the projection of vehicle loading or equipment,
(d) to amend the Road Transport (Vehicle Registration) Regulation 2007 to increase fees relating principally to registration and inspection of motor vehicles.

The increases are generally in line with movements in the Consumer Price Index. The decrease outlined in paragraph (c) brings the fees for permits applicable to light vehicles into line with those charged by the National Heavy Vehicle Regulator for equivalent permits applicable to heavy vehicles.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 24 and Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport Legislation Amendment (Fees, Penalty Levels and Charges) Regulation 2014.

2      Commencement

This Regulation commences on 1 July 2014 and is required to be published on the
NSW legislation website.

For the purposes of this Regulation, penalty amounts are expressed in terms of
the following levels:
Level 1 means a penalty of $69.
Level 2 means a penalty of $104.
Level 2A means a penalty of $109.
Level 3 means a penalty of $173.
Level 3A means a penalty of $182.
Level 4 means a penalty of $242.
Level 4A means a penalty of $254.
Level 5 means a penalty of $311.
Level 5A means a penalty of $327.
Level 6 means a penalty of $415.
Level 6A means a penalty of $436.
Level 7 means a penalty of $519.
Level 7A means a penalty of $545.
