Road Transport (General) Amendment

(Tracked Vehicles) Regulation 2011

Road Transport (General) Act 2005

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (General) Act 2005.

Explanatory note
The object of this Regulation is to prescribe tracked vehicles (such as bulldozers and tractors) and vehicles on runners inside endless tracks as vehicles within the meaning of the Road Transport (General) Act 2005. The Act currently only applies to vehicles on wheels.

This Regulation is made under the Road Transport (General) Act 2005, including the definition of vehicle in section 3 (1) and section 10 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Road Transport (General) Amendment (Tracked
Vehicles) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Road Transport (General) Regulation 2005

Clause 171A

Insert before clause 172:

171A Meaning of “vehicle”

For the purposes of paragraph (b) of the definition of vehicle in section 3 (1) of the Act, any description of tracked vehicle (such as a bulldozer), or any description of vehicle that moves on revolving runners inside endless tracks, that is not used exclusively on a railway or tramway is prescribed.
