Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (General) Act 2005.

Explanatory note

The object of this Regulation is to authorise Roads and Traffic Authority enforcement officers to issue penalty notices for over-height vehicle offences under the Road Rules 2008 and for certain driving offences under those Rules (such as tail-gating or driving in the dark without lights on) that are committed in Safe-T-Cam zones or average speed detection zones. This Regulation is made under the Road Transport (General) Act 2005, including section 10 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Road Transport (General) Amendment (Penalty
Notice Offences) Regulation 2011.

2      Commencement

This Regulation commences on 14 January 2011 and is required to be published on the NSW legislation website.

[1]      Schedule 3 Penalty notice offences

Insert “, 2” after “Class 1” wherever occurring in column 2 of the matter relating to rule 102 of the Road Rules 2008.

[2]      Schedule 3

Insert “, 2” after “Class 1” wherever occurring in column 2 of so much of the matter relating to rules 127 (1), 146, 147, 150 (1) and 215–1 (1) of the Road Rules 2008 as relates to a class B or class C motor vehicle in a Safe-T-Cam zone or average speed detection zone.

Insert “, 2” after “Class 1” in column 2 of paragraph (a) of the matter relating to rule 132 of the Road Rules 2008.
