(Penalty Notice Offences) Regulation

Road Transport (General) Act 2005

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (General) Act 2005.

Explanatory note
The object of this Regulation is to prescribe the following offences as penalty notice offences:

(a)	an offence under section 179 (6) of the Road Transport (General) Act 2005 relating to the failure to supply the name and address of a person who was in charge of a vehicle at the time of a camera recorded offence,
(b)	an offence under section 179 (7) of the Road Transport (General) Act 2005 relating to the false nomination of another person as the person who was in charge of a vehicle at the time of a camera recorded offence.

This Regulation is made under the Road Transport (General) Act 2005, including sections 10

(the general regulation-making power) and 183.

1      Name of Regulation

This Regulation is the Road Transport (General) Amendment (Penalty
Notice Offences) Regulation 2006.

2      Commencement

This Regulation commences on 3 February 2006.

3 Amendment of Road Transport (General) Regulation 2005

The Road Transport (General) Regulation 2005 is amended by inserting the following in appropriate order by section number in Columns 1, 2 and 3 in Schedule 3 under the matter relating to the Road Transport (General) Act 2005:

Section 179 (6); section 179 (7)

(a)	if the offence relates to a vehicle	Class 1	Level 12
registered otherwise than in the name of a natural person
(b)	in any other case	Class 1	Level 8
