Regulation under the Road Transport Act 2013.

Explanatory note

The object of this Regulation is to increase penalty levels dealt with by way of a penalty notice issued under the Road Transport Act 2013. The increases are generally in line with movements in the Consumer Price Index.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 195(3).

1      Name of Regulation

This Regulation is the Road Transport (General) Amendment (Penalties) Regulation

2020.

2      Commencement

This Regulation commences on 1 July 2020 and is required to be published on the
NSW legislation website.

[1]      Clause 123

Omit the clause. Insert instead—

123 Penalty levels

For the purposes of this Regulation, penalty amounts are expressed in terms of the following levels—

Level 1 means a penalty of $78.
Level 2 means a penalty of $116.
Level 2A means a penalty of $123.
Level 3 means a penalty of $194.
Level 3A means a penalty of $203.
Level 4 means a penalty of $272.
Level 4A means a penalty of $285.
Level 5 means a penalty of $349.
Level 5A means a penalty of $365.
Level 6 means a penalty of $464.
Level 6A means a penalty of $489.
Level 7 means a penalty of $581.
Level 7A means a penalty of $609.
Level 8 means a penalty of $697.
Level 8A means a penalty of $732.
Level 9 means a penalty of $890.
Level 9A means a penalty of $935.
Level 10 means a penalty of $1,123.
Level 10A means a penalty of $1,179.
Level 11 means a penalty of $1,393.
Level 11A means a penalty of $1,464.
Level 12 means a penalty of $1,472.
Level 12A means a penalty of $1,545.
Level 13 means a penalty of $1,819.
Level 14 means a penalty of $2,400.
Level 14A means a penalty of $2,520.
Level 15 means a penalty of $2,557.
Level 15A means a penalty of $2,676.
Level 16 means a penalty of $3,639.
Level 16A means a penalty of $3,821.
Level 17 means a penalty of $3,947.

Level 17A means a penalty of $3,955.

Note. “A” numbers are used in relation to motor vehicle speeding offences under rule

20 of the Road Rules 2014.

[2]      Clause 123B Lower penalty levels for certain parking offences dealt with by penalty notice

Omit “$82” from clause 123B(1). Insert instead “$83”.
