Regulation under the Road Transport Act 2013.

Explanatory note

The object of this Regulation is to reduce from $112 to $80 the penalty for certain parking offences under the Local Government Act 1993 and the Road Rules 2014 that are dealt with by penalty notices issued on behalf of certain issuing agencies.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 195 (3).

1      Name of Regulation

This Regulation is the Road Transport (General) Amendment (Further Parking Fine

Reductions) Regulation 2018.

2      Commencement

This Regulation commences on 1 January 2019 and is required to be published on the
NSW legislation website.

3 Amendment of Road Transport (General) Regulation 2013

Clause 123B Lower penalty levels for certain parking offences dealt with by penalty notice

Omit definitions of designated university parking offence and relevant parking

offence from clause 123B (4).

Insert in alphabetical order:

designated university parking offence means an offence that is created
by rule 168–1, 179–1, 207–1, 207–2, 207–3, 207–4, 207–5, 207–6,

207–7, 207–8 or 207–9 of the Road Rules 2014.

relevant parking offence means an offence that is created by any of the

following provisions:

(a) section 650 (1) (in relation to a notice or sign referred to in section 650 (2) (a) or (b)), (4) or (5) of the Local Government

Act 1993,

(b) section 650A (1) (in relation to a notice or sign referred to in section 650A (2) (a) or (b)), (4) or (5) of the Local Government

Act 1993,

(c) rule 168–1, 179–1, 184 (1) (other than in relation to a minibus zone in a clearway, transit lane or bus lane), 205, 207–1, 207–2, 207–3, 207–4, 207–5, 207–6, 207–7, 207–8, 207–9, 210 or 211 of the Road Rules 2014.
