Road Transport (General) Amendment (Authorised Officers) Regulation 2016

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Road Transport Act 2013.

Explanatory note
The objects of this Regulation are:

(a)	to authorise Class 2 officers (ie officers who are employed or controlled by Roads and Maritime Services) to issue penalty notices for certain traffic offences under the Road Rules 2014, and
(b)	to enable those officers to issue penalty notices for breaches of Rule 187 (1) of the Road Rules 2014, which prohibits unauthorised stopping in a bus, transit or truck lane.

This Regulation is made under the Road Transport Act 2013, including sections 23 and 24 (the general regulation and rule-making power) and 195 (Penalty notices for certain offences) and Schedule 1.

1      Name of Regulation

This Regulation is the Road Transport (General) Amendment (Authorised Officers)
Regulation 2016.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

Regulation 2013

[1]      Schedule 5 Penalty notice offences

Insert “2,” after “1,” wherever occurring in Column 2 of the matter relating to the following
provisions of the Road Rules 2014:
Rule 183 (1), otherwise than in school zone
Rule 183 (1), in school zone
Rule 184 (1), in relation to a minibus zone in a clearway, transit lane or bus lane
Rule 184 (1), otherwise than in relation to a minibus zone in a clearway, transit lane or bus
lane
Rule 195 (1), otherwise than in school zone
Rule 195 (1), in school zone
Rule 195 (1–1), otherwise than in a school zone
Rule 195 (1–1), in a school zone

Omit the matter relating to Rule 182 (1); Rule 196 (1) of the Road Rules 2014.
Insert instead:
