An Act to amend the Road Transport (General) Act 1999

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Road Transport (General) Amendment Act 2004 (No 2).

  2. Commencement

    This Act commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This Act amends the Road Transport (General) Act 1999.

  4. Risks not insured under third-party policies
    Section 171

    (1)A third-party policy does not

  5. New section 171 (2) and (3)

    insert

    (2)To remove any doubt, a third-party policy does not insure the owner or driver of a motor vehicle if—

    (a)the motor vehicle is in an area that is subject to a declaration under section 12 that has the effect of disapplying part 10 (or part 10 and any other provision of the road transport legislation); or

    (b)the motor vehicle is subject to a declaration under section 13 that has the effect of disapplying part 10 (or part 10 and any other provision of the road transport legislation); or

    (c)the owner or driver is subject to a declaration under section 13 that has the effect of disapplying part 10 (or part 10 and any other provision of the road transport legislation).

    (3)Also, to remove any doubt, the reference to any other territory law in section 169 (1) does not include a reference to this section or a declaration made under section 12 or section 13.
