Name of regulation
This regulation is the Road Transport (Driver Licensing) Amendment Regulation 2016 (No 1).
Commencement
This regulation commences on the day after its notification day.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
This regulation amends the Road Transport (Driver Licensing) Regulation 2000.

New section 22 (3)
insert
(3)Subsection (2) (b) does not apply if the person—
(a)is a police trainee undertaking recruit training or assessment; and
(b)is driving a police vehicle.
Section 37 (3)
substitute
(3)Subsection (2) does not apply if—
(a)the person has held a provisional licence (other than a provisional motorcycle licence) for at least 6 months and—
(i)is at least 26 years old; or
(ii)has, at any time, successfully completed an approved provisional driver training course and has provided evidence to the road transport authority, in a form acceptable to the authority, of the person’s successful completion of the course; or
Note 1Under s 68 (1) periods of licence suspension or disqualification are not counted and every other period when the person has, at any time, held a provisional car licence or licence of a higher class is counted.
Note 2Under s 68 (2) any period when the person has, at any time, held a probationary car licence or licence of a higher class is also counted.
(b)the person—
(i)is a police trainee undertaking recruit training or assessment; and
(ii)is driving a police vehicle.
New section 99B
insert
99BPolice officers—full licence manual transmission—Act, s 28 (2)
(1)This section applies to a police officer who is the holder of a car licence that is subject to the condition shown by the driver licence condition code A (which requires the person to drive only a motor vehicle fitted with automatic transmission).
(2)The police officer is eligible to apply to the road transport authority for the issue of a full car licence that is not subject to the condition.
NoteIf the road transport authority approves the application, the authority must issue the full licence (see s 40).
