  1. Name of regulation

    This regulation is the Road Transport (Driver Licensing) Amendment Regulation 2006 (No 1).

  2. Commencement

    This regulation commences on 1 December 2006.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Road Transport (Driver Licensing) Regulation 2000.

  4. Section 6 (1)

    insert

    (3)However, if a provisional licence was varied before the commencement of this subsection to become also a public vehicle licence, subsections (1) and (2) do not affect the validity of the provisional or public vehicle licence.

    (4)Subsection (3) and this subsection expire 3 years after the day this subsection commences.

    (f)for a public vehicle licence for a hire car that is a motorbike—

    (i)the person holds a full motorcycle licence, and has held a provisional or full motorcycle licence for at least 3 years (or for periods totalling at least 3 years); or

    (ii)the person has, in the last 5 years, held an external territory driver licence corresponding to a full motorcycle licence and has held a full motorcycle licence for at least 1 year in the last 5 years; or

    (iii)the person has, in the last 5 years, held a foreign driver licence corresponding to a full motorcycle licence and has held a full motorcycle licence for at least 1 year in the last 5 years; and

    (g)for a public vehicle licence for a public bus—

    (i)the person holds a light rigid vehicle licence or an Australian driver licence of a higher class, and has held a provisional or full car licence or an Australian driver licence of a higher class for at least 3 years (or for periods totalling 3 years); or

    (ii)the person has, in the last 5 years, held an external territory driver licence corresponding to a full light rigid vehicle licence or an Australian driver licence of a higher class and has held a full light rigid vehicle licence or an Australian driver licence of a higher class for at least 1 year in the last 5 years; or

    (iii)the person has, in the last 5 years, held a foreign driver licence corresponding to a full light rigid vehicle licence or an Australian driver licence of a higher class and has held a full light rigid vehicle licence or an Australian driver licence of a higher class for at least 1 year in the last 5 years; and

    (h)for a public vehicle licence to drive any other kind of public vehicle—

    (i)the person holds a full car licence or an Australian driver licence of a higher class, and has held a provisional or full car licence or an Australian driver licence of a higher class for at least 3 years (or for periods totalling at least 3 years); or

    (ii)the person has, in the last 5 years, held an external territory driver licence corresponding to a full car licence or an Australian driver licence of a higher class and has held a full car licence or an Australian driver licence of a higher class for at least 1 year in the last 5 years; or

    (iii)the person has, in the last 5 years, held a foreign driver licence corresponding to a full car licence or an Australian driver licence of a higher class and has held a full car licence or an Australian driver licence of a higher class for at least 1 year in the last 5 years.
