Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Driver Licensing) Act 1998.

Explanatory note
The object of this Regulation is to amend the Road Transport (Driver Licensing) Regulation
2008:
| (a) | to exempt police officers driving police vehicles who are holders of provisional P2 licences from the licence condition imposed on such licence holders requiring the display of a green P plate on vehicles driven by them, and |
| (b) | to exempt police officers driving police vehicles who are holders of provisional P1 licences from the licence condition imposed on holders of such licences not to drive a vehicle at any time between 11 pm on one day and 5 am on the following day with more than one passenger in or on the vehicle who is less than 21 years of age. |
This Regulation is made under the Road Transport (Driver Licensing) Act 1998, including sections 19 (the general regulation-making power) and 20.

1 Name of Regulation
This Regulation is the Road Transport (Driver Licensing) Amendment
(Police Exemptions) Regulation 2011.
2 Commencement
This Regulation commences on the day on which it is published on the
NSW legislation website.

Omit “emergency vehicle, within the meaning of the Road Rules 2008,” from clause 28 (2).
Insert instead “emergency vehicle or police vehicle (within the meaning of the
Road Rules 2008)”.[2] Clause 28A Conditions to which provisional P2 licence of class R is subject
Omit “emergency vehicle, within the meaning of the Road Rules 2008,” from clause 28A (2).
Insert instead “emergency vehicle or police vehicle (within the meaning of the
Road Rules 2008)”.[3] Clause 34 Restrictions on passengers under 21

Insert instead “emergency vehicle or police vehicle (within the meaning of the
Road Rules 2008)”.
