Her Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Road Transport Act 2013.

Explanatory note
The objects of this Regulation are:
| (a) | to allow a NSW police officer, and anyone residing with that police officer, to display an address other than a residential address on their driver licence, if those details have been suppressed in the driver licence register, and |
| (b) | to make provision for the date on which certain exemptions given to interstate drivers cease, and |
| (c) | to allow Roads and Maritime Services to carry out a manual search of the NSW driver licence register to verify the validity of a driver licence issued in NSW and provide the retrieved information to a participant in the Document Verification System (DVS) if a verification request from that participant via the DVS has failed to verify the validity of that driver licence. |
This Regulation is made under the Road Transport Act 2013, including section 23 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Road Transport (Driver Licensing) Amendment
(Miscellaneous) Regulation 2013.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.

[1] Clause 10 Form of driver licence
Insert after clause 10 (2) (b):
(b1) a police officer if the NSW driver licence register indicates that
information relating to that officer’s residential address is suppressed,
[2] Clause 10 (2) (c)
Omit “(a) or (b)”. Insert instead “(a), (b) or (b1)”.
[3] Clause 99 Interstate and international visitors
Insert after clause 99 (4):
(4A) However, if the Authority forms an opinion that subclause (4) (f) or (g) applies to a visiting driver, the cessation of the exemption does not take effect until the date nominated by the Authority for cessation of the exemption in the notice given to the visiting driver under subclause (6). Insert “, on and from the date nominated in the notice,” after “is”.

Insert after clause 109A:
| 109B | Release of identifying information to certain DVS participants | |

(a)
carry out a search of the NSW driver licence register for information directly relating to that verification request, and
(b)
provide to the user agency making that verification request only so much of the information referred to in clause 103 (1) as is necessary to satisfy the verification request.
(2) In this clause:
DVS has the same meaning as in clause 109A.
user agency means a DVS participant that is a government agency of this or
any other Australian jurisdiction.
verification request means a request sent by a user agency via the DVS to
verify the validity of a driver licence issued in NSW.
