Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Driver Licensing) Act 1998.

Explanatory note
The object of this Regulation is to allow Roads and Maritime Services to waive part of the fee payable in relation to the renewal of a driver licence (other than a provisional or learner licence) by up to 50 per cent of the amount of that fee.

This Regulation is made under the Road Transport (Driver Licensing) Act 1998, including sections 19 (the general regulation-making power) and 20.

1      Name of Regulation

This Regulation is the Road Transport (Driver Licensing) Amendment
(Licence Renewal Fees) Regulation 2012.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Road Transport (Driver Licensing) Regulation 2008

(1) Clause 112 Waiver of fees

Insert “(whether wholly or in part)” after “may waive” in clause 112 (1).

(2) Clause 112 (2)
Omit the subclause. Insert instead:
(2) Without limiting subclause (1), the Authority may:
(a) waive payment of a fee in relation to a learner licence if the applicant is, when making the application, the holder of a learner licence issued by another jurisdiction, or
(b) waive payment of part of any fee payable for the renewal of a driver licence (other than a provisional licence or learner licence) by an amount not exceeding 50 per cent of that fee.
