Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Road Transport Act 2013.

Explanatory note

The object of this Regulation is to provide that a person may display a digital driver licence in compliance with a request to produce a driver licence by the following:

(a) an authorised officer under the Point to Point Transport (Taxis and Hire Vehicles) Regulation 2017,
(b) an authorised officer under the Passenger Transport (General) Regulation 2017.

This Regulation is made under the Road Transport Act 2013, including sections 23 (the general statutory rule-making power) and 61A (definition of relevant purpose).

1      Name of Regulation

This Regulation is the Road Transport (Driver Licensing) Amendment (Digital

Driver Licences) Regulation (No 2) 2019.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Road Transport (Driver Licensing) Regulation 2017

Clause 125A Additional relevant purposes for use of digital driver licence

Insert after clause 125A(1)(b):

(c) to comply with a request of an authorised officer under clause 71(1) of the Point to Point Transport (Taxis and Hire Vehicles)

Regulation 2017 to produce a driver licence,

(d) to comply with a request of an authorised officer under clause 45(1) of the Passenger Transport (General) Regulation 2017 to produce a driver licence.
