Editorial changes
The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication. Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.
This republication includes amendments made under part 11.3 (see endnote 1).

Penalties

This regulation is the Road Transport (Alcohol and Drugs) Regulation 2000.
Alcohol screening device—Act, s 7, def alcohol screening device
The following devices are prescribed:
(a)Alcolizer LE;
(b)lion alcolmeter SD-400;
(c)Alcolizer 5 Series;
(d)Alcolizer LE 5 Series.
Breath analysis instrument—Act, s 7A, def breath analysis instrument
The following instruments are prescribed:
(a)Dräger Alcotest 7110 MKV, also known as the Draeger Alcotest 7110 MKV;
(b)Dräger Alcotest 9510 AUS, also known as the Draeger Alcotest 9510 AUS.
3ADrug screening device—Act, s 7B, def drug screening device
The following devices are prescribed:
(a)Securetec DrugWipe 3 S;
(b)Securetec DrugWipe TWIN, also known as the Securetec DrugWipe II TWIN.
3BOral fluid analysis instruments—Act, s 7C, def oral fluid analysis instrument
The following instruments are prescribed:
(a)Cozart DDS;
(b)Dräger DrugTest 5000, also known as the Draeger DrugTest 5000.
Breath analysis—requirements for statement under Act, s 12 (5)
A statement given to a person under the Act, section 12 (5) in relation to an analysis of a sample of the person’s breath must include the information mentioned in schedule 1.
Oral fluid analysis—requirements for statement under Act, s 13E (6)
The particulars mentioned in schedule 2 are required to be included in a statement mentioned in the Act, section 13E (6).
5APrescribed drugs—Act, dict, def prescribed drug
The following are prescribed:
(a)delta-9-tetrahydrocannabinol;
(b)methylamphetamine;
(c)N, α-Dimethyl-3,4-(Methylenedioxy)phenylethylamine;
(d)cocaine.
Sampling facility—Act, dict, def sampling facility
(1)The following are prescribed:
(a)a police station;
(b)a police vehicle that is—
(i)a truck, bus or trailer; and
(ii)equipped for the purpose of conducting alcohol or drug tests under the Act.
(2)In this section:
bus—see the Road Transport (Vehicle Registration) Regulation 2000, dictionary.
police station—see the Crimes Act 1900, section 185.
police vehicle—see the Road Transport (Vehicle Registration) Regulation 2000, dictionary.
trailer—see the Road Transport (General) Act 1999, dictionary.
truck—see the Road Transport (Vehicle Registration) Regulation 2000, dictionary.
Schedule 1Particulars for breath analysis statement
(see s 4)
the type and serial number of the instrument used in carrying out the breath analysis and the test number
the date, start time and location where the test was carried out
the name and date of birth of the person providing a sample of his or her breath for analysis
the name of the police officer who has custody of the person under the Act, section 11 (who may be referred to in the statement as the informant)
the service number and signature of the authorised operator
whether self-tests were conducted on the instrument before and after analysis and the time and the result of any such test
if the breath sample was tested on ‘override’ mode, that fact
the date and time when the sample of breath was analysed
the result of the breath analysis as shown by the instrument
Schedule 2 Particulars for oral fluid analysis statement
(see s 5)
the type and serial number of the instrument used in carrying out the oral fluid analysis and the test number
the name and date of birth of the person providing a sample of his or her oral fluid for analysis
the unique identifying number for the sample of oral fluid taken for analysis
the service number and signature of the authorised operator who carried out the oral fluid analysis
the date and time when the sample of oral fluid was analysed
the result of the oral fluid analysis as shown by the instrument
