ROAD TRAFFIC (WARDENS) AMENDMENT REGULATIONS 1994
Made by His Excellency the Governor in Executive Council.
Citation
1.
Amendment Regulations 1994. These regulations may be cited as the Road Traffic (Wardens)
(a) the certificate of appointment of the person as such a warden shall be in the form of Form 5; and

Regulation 6 inserted
3. After regulation 5 of the principal regulations the following regulation is
inserted —
Heavy Haulage Wardens

to be a warden to perform duties relating to the enforcement of Where a person has been appointed under section 13 (4) (c) load dimensions and mass limits of goods vehicles —

(b) any warden so appointed has the powers conferred on a member of the Police Force under —
(i) section 53 (1) and (2) of the Road Traffic Act 1973, when that warden is performing the duties set out in subparagraph (in);
(ii) regulation 202 of the Road Traffic Code 1975, when that warden is performing the duties set out in subparagraph (iii);
(iii) Part 11 and 14 of the Road Traffic (Vehicle Standards) Regulations 1977, when carried out in relation to any goods vehicle; and
(iv)
section 102 (1) of the Road Traffic Act 1975, to serve a traffic infringement notice for an alleged offence set out in items 63, 63A-H, 66, 67 or 68 of the First Schedule to the Road Traffic (Infringements) Regulations 1975.

4. The Schedule to the principal regulations is amended by adding after

This is to certify that

is duly appointed under section 13 (4) (c) of the Road Traffic Act 1974, to perform duties relating to the enforcement of load
dimensions and mass limits of goods vehicles and has such powers as are conferred on such wardens by the Act and regulation 6 of the Road Traffic (Wardens) Regulations 1986.
