Part 1—Preliminary

1—Short title

These rules may be cited as the Road Traffic (Vehicle Standards) Variation Rules 2006.

2—Commencement

These rules come into operation on the day on which they are made.

3—Variation provisions

In these rules, a provision under a heading referring to the variation of specified rules varies the rules so specified.

4—Variation of rule 34—Horns, alarms etc

Rule 34(3)(c), (d) and (e)—delete paragraphs (c), (d) and (e)

5—Variation of rule 118—Other lights and reflectors

  1. Rule 118(1), definition of exempt vehicle—delete the definition and substitute:

    exempt vehicle means—

    (a)a police vehicle; or

    (b)an emergency vehicle.

  2. Rule 118(1), definition of special use vehicle, Examples—after example 6 insert:

    7Buses fitted for use on the track commonly known as the O-Bahn busway.

  3. Rule 118(4)—delete subrule (4) and substitute:

    (4)Despite any requirement of a third edition ADR—

    (a)an exempt vehicle may be fitted with any light or reflector;

    (b)a special use vehicle may be fitted with 1 or more flashing yellow lights;

    (c)a State Government enforcement vehicle may be fitted with 1 or more flashing magenta lights.

6—Variation of Dictionary

  1. Dictionary, definition of emergency vehicle—after paragraph (g) insert:

    (h)a member of the Australian Protective Service or the Australian Customs Service;

    (i)an employee of Airservices Australia engaged in fire fighting duties or duties in connection with any emergency.

  2. Dictionary, definition of State Government enforcement vehicle, (a)—after "inspector" insert:

    appointed under section 35(1) of the Road Traffic Act 1961

  3. Dictionary, definition of State Government enforcement vehicle—after paragraph (b) insert:

    or

    (c)a fisheries officer under the Fisheries Act 1982,

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these rules come into operation as set out in these rules.
