Amendment Regulations 2006

Made by the Lieutenant-Governor and Administrator in Executive
Council.

1.            Citation

These regulations are the Road Traffic (Towed Agricultural
Implements) Amendment Regulations 2006.

2.            The regulations amended

The amendments in these regulations are to the Road Traffic
(Towed Agricultural Implements) Regulations 1995* .

3.            Regulation 3 amended

(1) Regulation 3(1) is amended as follows:

(a)

by inserting the following definitions in the appropriate alphabetical positions -

"

"flashing amber light" has a meaning that is affected

by regulation 11;

"night-time" means the period between sunset and

sunrise;

(b) in the definition of "used" by deleting 'motor";

(c)

by deleting the definitions of "agricultural implement", "combination", "escort vehicle", "hours of darkness" and "pilot vehicle".

(2) After regulation 3(2) the following subregulation is inserted -

"

(3) Unless the contrary intention appears, a term used in

these regulations has the same meaning as it has in the
Road Traffic (Vehicle Standards) Regulations 2002.

4.            Regulation 6 amended

Regulation 6(2) is amended by inserting after "combination" in the first place where it occurs -

" of which the towed implement is a part

5. Regulation 7 amended
Regulation 7(2)(a) is amended by deleting "and (d)".

6.            Regulation 11 replaced

Regulation 11 is repealed and the following regulation is
inserted instead -

11.          Flashing amber light

If a provision of these regulations requires the use of a flashing amber light, the light and its use must comply with Schedule 2 clauses 39(a) and (b) and 40, and if the light is not a strobe light, clause 39(c) of the Road Traffic (Vehicle Standards) Regulations 2002.

7. Regulation 14 amended
Regulation 14(1) is amended as follows:

(a) by deleting "forming part of a combination",-

(b) by deleting "a combination" in the second place where it

occurs and inserting instead -

an agricultural combination ".

8.            Regulation 15 amended

Regulation 15 is amended by inserting before
"combinations" -

9.            Regulation 16 amended

(1) Regulation 16(1) is amended by deleting "a tractor" and
inserting instead -

an agricultural machine ".

(2) Regulation 16(2) is amended by deleting the definition of
"tractor".

10.          Regulation 20 amended

Regulation 20(1) is amended by deleting "a combination" and inserting instead -

an agricultural combination, ".

11.          Regulation 21 replaced

Regulation 21 is repealed and the following regulation is inserted instead -

21.          Head lights

An agricultural vehicle, or the front vehicle in an agricultural combination, must have its low-beam headlights on while travelling in the daytime, unless it

is not required under the Vehicle Standards to have

headlights.

12.          Regulation 25 amended

(1) Regulation 25(1)(b) is amended by deleting an escort" and

inserting instead -

" a pilot ".

(2) Regulation 25(2) is amended as follows:

(a) by deleting "and escort";
(b)

in paragraph (b)(i) and (ii) by deleting 'stroke of" and " stroke at least

(3) Regulation 25(4) is amended by deleting "and an escort

vehicle".

(4) Regulation 25(5) is amended by deleting "an escort vehicle" and

inserting instead -

a pilot vehicle to the rear of the combination ".

13. Regulation 25A inserted
After regulation 25 the following regulation is inserted -
25A. Communication between drivers
(1) An oversize agricultural combination and any
accompanying pilot vehicle or escort vehicle must each
have an electronic device that allows the drivers to
communicate effectively with each other.
(2) Subregulation (1) does not apply if—
(a) the combination includes an oversize agricultural machine; or
(b) the escort vehicle (if there is one) is a police
vehicle. "

14.          Regulation 26 amended

(1) Regulation 26(1) is amended by inserting before

"combinations" -

agricultural ".

(2) Regulation 26(2) is amended as follows:

(a)

by deleting "where a combination" and inserting instead -

"

to an agricultural combination if the combination

(b) by inserting before "combination" in the second place where it occurs -

(c) by deleting "an escort" and inserting instead - " a pilot ".

15.          Regulation 27 amended

Regulation 27(1) is amended by deleting "Electricity Corporation established by" and inserting instead -

Western Power Corporation referred to in section 4 of ".

16.          Regulation 28 amended

Regulation 28(2) and (5) are amended by deleting "Department"
and inserting instead -

Service ".

17. Various references to "combination" changed to
"agricultural combination"
(1) Each provision listed in the Table to this subregulation is
amended by deleting "A combination" in each place where it
occurs and inserting instead —
" An agricultural combination ".
