Part 1—Preliminary

1—Short title

These regulations may be cited as the Road Traffic (Road Rules—Ancillary and Miscellaneous Provisions) Variation Regulations 2009.

2—Commencement

These regulations will come into operation on the day on which section 24 of the Statutes Amendment (Transport Portfolio—Alcohol and Drugs) Act 2009 comes into operation.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Road Traffic (Road Rules—Ancillary and Miscellaneous Provisions) Regulations 1999

4—Variation of regulation 13—Vehicles (other than public buses or trucks) permitted to stop in loading zone

  1. Regulation 13(1)(d)—delete paragraph (d) and substitute:

    (d)a vehicle to which an alcohol interlock is fitted is permitted to stop in a loading zone to enable the driver to take action to comply with alcohol interlock scheme conditions to which the driver's licence of the driver is subject, provided that the vehicle stops for no longer than is necessary in the circumstances.

  2. Regulation 13—after subregulation (3) insert:

    (4)In this regulation, alcohol interlock and alcohol interlock scheme conditions have the same respective meanings as in the Motor Vehicles Act 1959.

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
