Road Traffic Regulations Amendment

(Penalties) Regulations 2017

(a)	Part 1 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day 9 weeks after
that day.

Made by the Governor in Executive Council.

Part l — Preliminary

1.            Citation

These regulations are the Road Traffic Regulations Amendment
(Penalties) Regulations 2017.

2.             Commencement

These regulations come into operation as follows —

Part 2— Road Traffic (Administration)

Regulations 2014 amended

3.            Regulations amended

This Part amends the Road Traffic (Administration)
Regulations 2014.

4.            Regulation 21 amended

(1)	In regulation 21 in the Table after the item for s. 33(2) insert:
s. 36(2)(a) Obtaining or applying 15

for a driver's licence

while disqualified

s. 36(2)(g)	Lending or allowing	15
another person to use a driver's licence document, vehicle licence or number plate or label

(2)	In regulation 21 in the Table after the item for s. 4 7(2) insert:
s.47(4) Failure to comply with direction under s.47(3)
s. 140(4) Failure to comply with 2

a notice under

s. 140(2)

5.            Regulation 21A inserted

After regulation 21 insert:

21A.	Infringement notice offences and penalties: Road Traffic (Authorisation to Drive) Act 2008
An offence under the Road Traffic (Authorisation to Drive) Act 2008 section 7(2)(possessing a driver's licence that is void because of section 7(1) of that Act) is prescribed for section 79, and 10 PU is prescribed to be the amount of the penalty for the offence if dealt with under the Road Traffic (Administration) Act 2008 Part 5 Division 1.

6.	Regulation 22 amended In regulation 22(1) in the Table after the item for s. 4(2) insert:

7.            Regulation 23 amended

(1)	In regulation 23(2) in the Table after the item for s. 50A(1) insert:

(2)	In regulation 23(2) in the 'Fable after the item for s. 64AAA insert:
s. 81F(1) Obstructing the use of, or misusing, road closed for events 4

8.            Regulation 26 amended

In regulation 26 in the Table in the item for the Road Traffic
(Administration) Act 2008 delete "s. 33(2) and 44" and insert:

s. 33(2), 36(2), 44 and 47(4) 

Part 3 — Road Traffic (Authorisation to Drive)

Regulations 2014 amended

This Part amends the Road Traffic (Authorisation to Drive) Regulations 2014.
10.	Regulation 35 amended In regulation 35(2) after the Penalty insert:

Modified penalty for this subregulation: 1 PU.
