Part 1—Preliminary

1—Short title

These regulations may be cited as the Road Traffic (Miscellaneous) Variation Regulations 2006.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Road Traffic (Miscellaneous) Regulations 1999

4—Variation of Schedule 1AAA—Notice of licence disqualification or suspension

  1. Schedule 1AAA—after "NOTICE OF LICENCE DISQUALIFICATION OR SUSPENSION" insert:

    under section 45B or section 47IAA

  2. Schedule 1AAA—delete the heading "PRESCRIBED CONCENTRATION OF ALCOHOL - Section 47IAA of the Road Traffic Act 1961" wherever occurring and substitute in each case:

    CATEGORY 2 OR 3 OFFENCE OR REFUSE / FAIL TO COMPLY - Section 47IAA of the Road Traffic Act 1961

  3. Schedule 1AAA—after "blood alcohol concentration 0.08 - 0.149" insert:

    (category 2 offence)

  4. Schedule 1AAA—delete "Section 47B(2)" wherever occurring and substitute in each case:

    Section 47B(1)

  5. Schedule 1AAA—after "blood alcohol concentration of or above 0.15" insert:

    (category 3 offence)

  6. Schedule 1AAA—delete "Section 45A(1)(a)" and substitute:

    Section 45A

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
